answer text <p>Local planning authorities are required to determine planning applications for development in accordance with their Local Plan, national policy and other material considerations.</p><p>The temporary national permitted development right for the change of use of light industrial buildings to residential use requires the building to have been in light industrial use on 19 March 2014, and if not in use on that date for light industry to have been the last use. There are no requirements in respect of how long the building must have been in that use. The right does not apply to buildings whose use for light industrial use commenced after 19 March 2014.</p> more like this

answer text <p>The National Planning Policy Framework (NPPF) sets out the government’s planning policies for England and how these are expected to be applied. This is supported by planning practice guidance.</p><p>The NPPF recommends that local planning authorities plan for a diverse range of housing however it is their responsibility to determine affordable housing policies, and to assess planning applications accordingly. It is up to local authorities to determine their policies for affordable housing, and to determine their planning applications accordingly.</p><p>Where local policies indicate that affordable housing provision is necessary, Section 106 of the Town and Country Planning Act 1990 requires developers to enter into obligations to provide affordable homes. These obligations must be fully justified and evidenced.</p> more like this

answer text <p>The National Planning Policy framework expects local authorities to identify and plan for the market and affordable housing needs of their area. The level and type of affordable housing provided on an individual site will depend on the Local Plan policies and overall viability of the proposal.</p><p>The Housing Act 1996 and the Housing and Regeneration Act 2008 require that new affordable homes delivered through the provision of Government Grant must remain affordable in perpetuity. Where a grant funded property is sold or undergoes a change of use, for example, from affordable housing to private rent or sale, the grant element used to build the property is then recycled for the delivery of further new affordable homes or returned to the Government. This ensures that the number of properties available through our Affordable Housing Programmes remains at a consistent level.</p><p> </p> more like this

answer text <p>Yes, the strict tests on flood risk set out in national planning policy apply to rural and urban areas. These tests include ensuring new development does not increase flood risk elsewhere.
