answer text <p>The rule of law is at the heart of the UK constitution. The duty of the Law Officers is to ensure that the Government acts lawfully at all times. answer text <p>I am committed to ensuring rape and sexual assault cases are conducted effectively – in fact, I recently successfully referred a point of law to the Court of Appeal to ensure that the law is clear in cases of sexual assault.</p><p>I have also engaged closely on CPS rape work, including meeting with CPS South East in December 2020 to discuss how their RASSO unit approaches these complex cases. The CPS and police also published their Joint National Action Plan on rape in January 2021 which shows their commitment to improvement.</p><p> </p> more like this

answer text <p>I have seen first-hand how innovatively and resiliently criminal justice agencies have responded to the pandemic to boost court capacity – in June 2020, I observed virtual hearings conducted via the Cloud Video Platform in Bristol Magistrates’ Court.</p><p>I have also met with various CPS Areas to discuss their approach, and know that the CPS is committed to working closely with the courts service and judiciary on court recovery work. This is an unprecedented challenge, but I have been impressed with the truly collaborative approach criminal justice partners have taken.</p> more like this

answer text <p>The CPS has worked with other prosecutors, law enforcement, the courts, and the Home Office to ensure that effective international cooperation with EU Member States on extradition, gathering of evidence and asset recovery can continue after the Transition Period.</p><p> </p><p>Extensive preparation has taken place to prepare for the outcome of the negotiation and there are well-prepared and well-reheased plans in place – which include producing guidance and training for prosecutors. answer text <p>I am delighted that my revised Disclosure Guidelines have now been published. These Guidelines will come into force on 31 December and will be key to the requisite culture change and thinking approach needed when investigators and prosecutors carry out their disclosure obligations.</p><p> </p><p>This will ensure that better, fairer decisions are made in criminal cases, which will help to ensure that fewer cases are dropped post-charge due to issues arising due to late disclosure.</p> more like this

answer text <p>Parliament is sovereign as a matter of domestic law and can pass legislation, even if such legislation is in breach of the UK’s treaty obligations. From time to time tensions arise between our international obligations and domestic legislation. In 2012, The House of Lords Reform Bill 2012-13 was brought forward with the statement that the Deputy Prime Minister at the time was ‘unable to make a statement of compatibility under section 19(1)(a) of the Human Rights Act 1998’ which reflects the UK’s obligations under the European Convention on Human Rights (this Bill was later withdrawn for other reasons). Whilst pre-dating 2010, a further example from 2002 was when the then Government introduced the Communications Bill with a section 19(1)(b) certificate under the Human Rights Act 1998 (ie that whilst the Minster is unable to make a statement of compatibility the government nevertheless wishes to proceed with the Bill) because it was perceived that clause 309 of that Bill could be considered to violate our international obligations under article 10 of the ECHR. The current legislative proposal, if enacted, would deliver the wider objectives of the Protocol, which is to protect peace in NI and the Belfast (Good Friday) Agreement.</p>

answer text <p>It is essential that perpetrators, victims and their families know and understand that the criminal justice system remains open and operational during the covid-19 outbreak. The Crown Prosecution Service (CPS) is working closely with colleagues across the Criminal Justice System to ensure that these offences continue to be brought to justice.</p><p> </p><p>The interim charging protocol <a href="https://www.cps.gov.uk/legal-guidance/coronavirus-interim-cps-charging-protocol-between-national-police-chiefs-council-and" target="_blank">‘Coronavirus: Interim CPS Charging Protocol between the National Police Chiefs' Council and Crown Prosecution Service’</a> was published on 31st March 2020. The interim protocol sets out how charging for all cases including domestic abuse should be managed by the police and the CPS.</p><p> </p><p>The interim protocol specifies that priority must be given to the most serious cases to make sure dangerous offenders are dealt with quickly. The protocol aims to prioritise and focus demand so we are only putting the most serious cases into the courts system immediately. All non-custody domestic abuse cases have been categorised as Category B - High Priority cases. The CPS is committed to working closely with criminal justice partners and the third sector to ensure that victims and witnesses remain at the heart of the process.</p>
